Bicycle rental conditions

RENTAL DOCUMENTATION

The rental of bicycles and accessories from Village Camping Joker is governed by these general rental conditions, the rental regulations, the rental agreement, the assumption of liability, the rental price list, and the price list for damage to the bicycles and accessories also referred to as the “repair cost table” (all of which is hereinafter referred to as the “Rental Documentation” for the sake of simplicity). These General Terms and Conditions have been drawn up in accordance with the provisions of Legislative Decree 206/2005, Part III, Chapter I, Section II as amended and supplemented (Consumer Code).

IDENTITY DOCUMENT

In order to rent a bicycle, the hirer (hereinafter referred to as the customer), who shall be the authorised driver of the vehicle, must comply with the identification and qualification formalities required by the hirer (hereinafter referred to as Village Camping Joker) by means of a valid identity document for registration. In the case of a request from several parties, the contract may be signed by a single customer, who must, however, provide Village Camping Joker with the full identification details of all customers.

MINORS

Use of the bicycle is reserved for adults only, unless the minor is accompanied by an adult who assumes full responsibility for any damage caused to third parties by the minor or suffered by the minor.

SECURITY DEPOSIT

When collecting the bicycle, the customer is required to hand over a deposit of Euro 20.00 EXCLUSIVELY FOR CASH per bicycle, plus Euro 5.00 for the lock, which will be returned at the end of the rental period after the bicycle has been checked and subject to any breakage as per the attached price list.

POSSESSION OF THE REQUIREMENTS

The use of a bicycle presupposes the physical fitness of the person who intends to ride it. Therefore, the customer, by signing the rental agreement and other documents, assumes full responsibility by declaring that he/she has adequate physical and intellectual ability to ride and manage the bicycle and therefore assumes full responsibility for any damage caused by his/her insufficient ability. Village Camping Joker may refuse the rental of the bicycle to a person who is not considered capable of riding it in accordance with the Road Safety Act or for any other justified reason.

CHECKING THE CONDITION AND FUNCTIONALITY OF THE BICYCLE

When taking delivery of the bicycle, the customer will check its perfect functionality together with Village Camping Joker. By taking delivery of the bicycle, the customer acknowledges it to be mechanically efficient and declares that he/she has previously checked its full functionality (any defects must be reported at the time of delivery) and that he/she has received from Village Camping Joker a full description of how to use it and that he/she understands it;

CORRECT USE OF THE BICYCLE AND ACCESSORIES

The customer must use the bicycle exclusively on his/her own responsibility, solely as a means of transport and in the manner intended for recreational and sporting activity. It is not transferable to others and must not be left unattended. The rented bicycle and accessories are to be used and treated with care, common sense and diligence.

COMPLIANCE WITH TRAFFIC REGULATIONS

The customer is obliged to comply with the rules of the Highway Code and may not use the bicycle under the influence of alcohol, drugs, sedatives, sleeping pills or other substances that may affect the driver’s driving ability. The use of a mobile phone while cycling is not permitted. Fines for traffic violations and any costs for recovering the bicycle(s) will be borne by the customer.

HIRER CHECKS

Village Camping Joker may carry out checks on hirers during the use of the bicycles and may demand their return if it detects conditions of improper use of the vehicle.

HIRER’S LIABILITY WAIVER

The hirer is responsible for the bicycle until it is returned to Village Camping Joker; he/she is also responsible for any damage caused to him/herself, to the bicycle, to third parties and to third party property during use of the bicycle. No form of compensation can be claimed from Village Camping Joker.

DAMAGE AND THEFT INSURANCE

The rented material is not insured, in the event of damage, total breakage, theft, the material in question will be charged to the customer according to the market value as stated in the price list for damage to bicycles and accessories also referred to as the “repair costs table”.

Village Camping Joker is expressly exonerated from any liability relating to accidents with material damage and/or personal injury caused by the customer and/or third parties.

OBLIGATION TO REPORT THEFT AND CHARGE FOR DAMAGE

In the event of theft, the customer is obliged to report the theft to the competent police force and must submit a copy of the report to Village Camping Joker. and pay the amount equal to the value of the stolen bicycle and accessories, which will be returned to him/her if the vehicle is found or recovered.

RETURN AND TIMES

Upon return of the bicycle and accessories, Village Camping Joker and the customer shall ascertain any damage to the borrowed and returned items. If the customer does not agree with the findings of Village Camping Joker, the latter has the right to act in accordance with these general rental terms and conditions, especially those concerning the payment of compensation for damage or missing accessories and the deposit.

TERMINATION CLAUSE

Violation by the customer of even one of the provisions of these general rental terms and conditions, the regulations and the rental agreement for the bicycle will entitle Village Camping Joker to terminate the contract with immediate effect and to take back the bicycle and accessories loaned to the customer. By entering into the rental agreement, the customer expressly agrees that he/she cannot appeal against the decision of Village Camping Joker in the preceding paragraph. The customer may exercise the rights that are relevant to him/her.

JURISDICTION

The rental relationship referred to in this Contract and any other relationship deriving therefrom shall be governed by Italian law. For any dispute arising from the relations regulated by the “Rental Documentation”, without prejudice to and without prejudice to the provisions of Article 33, paragraph 2, letter u, of the Consumer Code (Legislative Decree. 206/2005), i.e. the Court where the Consumer resides or is electively domiciled, the Court of Venice shall have exclusive jurisdiction.
